Terms of Service & Acceptable Use Policy

In short: call only people who agreed to hear from you, say who you are, stop when asked, never make cold promotional or prohibited calls, and verify your business before using an ExoCall number. Breaking these rules can get your account suspended immediately, and you are responsible for any complaint or penalty it causes.

1. About these terms

ExoCall is an AI calling service operated by Exasys Educational Services Pvt Ltd ("ExoCall", "we", "us"). These terms apply to every business that creates an ExoCall workspace ("you", "the customer") and to every person who uses the dashboard on its behalf. By creating an account, or by accepting these terms in the dashboard, you agree to them on behalf of your business.

The Acceptable Use Policy in sections 4 to 6 is part of these terms. It exists because the phone numbers ExoCall provides are registered under ExoCall's own telecom KYC: under the rules of the Telecom Regulatory Authority of India (TRAI), misuse of a number can lead to that number and our telecom account being disconnected or blacklisted.

2. The service

ExoCall provides an AI voice agent that answers and places phone calls, records and transcribes them, and scores leads, together with the phone line, AI and telephony usage covered by your plan. Plan prices, included minutes and limits are shown on the pricing page and in the dashboard.

AI agents can make mistakes. You are responsible for checking how your agent behaves, for the instructions ("prompts") and business information you give it, and for any decision you take based on call transcripts or lead scores.

3. Business verification

If your workspace uses a phone number provided by ExoCall, you must complete business verification before any call (inbound or outbound) is connected. We ask for your legal business name, GSTIN or PAN, address, an authorised person, how you will use calling, how the people you call agreed to be contacted, and supporting documents.

The information must be true and complete. We may refuse or withdraw verification at any time, including after a complaint, and calls stop while verification is withdrawn. Workspaces that connect their own telephony account are responsible for their own telecom KYC and registrations.

4. Who you may call

You may use ExoCall to call only people who have agreed to hear from your business, for example:

  • people who called you, filled in an enquiry form or ad, or asked for a call back;
  • your existing customers, about their orders, services, appointments, payments or renewals;
  • people who have otherwise given you clear consent to be called about the subject of the call.

Cold promotional calls are not allowed on ExoCall numbers. Do not upload purchased, scraped or shared contact lists, and do not call people who have never contacted your business. You must be able to show us, on request, how and when each person you called agreed to be contacted.

5. How calls must be made

  • Your agent must say which business is calling and why, early in the call.
  • No false, misleading or exaggerated claims about products, prices, returns, jobs or offers.
  • Stop calling anyone who says they do not want calls, and honour the National Customer Preference Register (DND) where it applies to your calls.
  • Call only between 9:00 AM and 9:00 PM Indian time, unless the person asked to be called at another time.
  • Do not pressure, harass, threaten or repeatedly call the same person.
  • Follow all applicable law, including TRAI regulations, the Telecom Commercial Communications Customer Preference Regulations, consumer protection law and the Digital Personal Data Protection Act, 2023.

6. Prohibited uses

You must never use ExoCall for:

  • debt or loan recovery that threatens, shames or harasses anyone, or contacts people other than the borrower;
  • betting, gambling, lotteries, prize schemes or "you have won" calls;
  • adult or sexual content;
  • political campaigning or election calls;
  • pretending to be a bank, government body, police, courier, telecom company or any other organisation or person;
  • asking for OTPs, passwords, card or bank details, or any other fraud or phishing;
  • unlicensed financial, investment, medical or legal advice, or schemes promising guaranteed returns;
  • anything illegal, hateful, abusive, or that infringes someone else's rights.

7. Your responsibility and indemnity

You are solely responsible for your prompts, contact lists, the calls made from your workspace and their content. You will indemnify and hold harmless Exasys Educational Services Pvt Ltd, its directors and employees against any complaint, claim, penalty, disconnection charge, loss or cost (including reasonable legal fees) arising from your use of ExoCall or from a breach of these terms, including any action by TRAI, the Department of Telecommunications or a telecom operator.

You will cooperate with us in handling any complaint about calls from your workspace, including sharing consent records within 48 hours of our request.

8. Monitoring, suspension and termination

To protect the phone numbers and our telecom account, we may review call recordings, transcripts, prompts and contact lists for compliance. We may pause campaigns, block calls or suspend your workspace immediately and without notice if we receive a complaint, if a telecom operator or regulator raises an issue, or if we believe these terms have been broken.

If your workspace is suspended or terminated for a breach of these terms, fees already paid are not refunded, and we may recover from you any penalty or charge we incur because of it. We may also report unlawful use to the authorities.

9. Data

You own your contact lists, recordings and transcripts. You are responsible for having a lawful basis to share personal data of the people you call with us. We process it only to provide the service, to handle complaints and to meet legal obligations, and we keep it secure. Business verification documents are stored privately and are seen only by the ExoCall team.

10. Limitation of liability

ExoCall is provided "as is". Calls depend on telecom networks and AI services that we do not fully control, and we do not guarantee uninterrupted service. To the extent permitted by law, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect or consequential losses such as lost business or profits.

11. Changes and governing law

We may update these terms. When we make a material change we will ask you to accept the new version in the dashboard before you continue using it. These terms are governed by the laws of India, and the courts at Surat, Gujarat have exclusive jurisdiction.
